Terms of Use

This translation is provided for convenience. Only the German version is legally binding.

1. Provider and scope

Abmarsch is provided by eastfreak Studios, owner Steffen Kilian, Semperstraße 3d, 01069 Dresden, Germany. Contact: kontakt@abmarsch.app.

These terms apply to the use of the Abmarsch app (phone, watch, widget) – free and with Abmarsch Plus. You buy Abmarsch Plus from the store (section 7); the store's terms apply to that purchase in addition. How we handle your data is described in the privacy policy.

2. What Abmarsch is

Abmarsch helps you leave and arrive on time: the app calculates backwards from your destination, wakes and reminds you, raises an alarm and shows your time buffer. With Abmarsch Plus, up to 6 people can connect as a family, suggest appointments to each other, agree on times and – only if the other person shares an appointment with them and only during that appointment – see its status or location. A watch app (Wear OS) and a widget are part of the app.

3. What Abmarsch is not

4. The leave alarm

The leave alarm is deliberately persistent: it only ends when the app detects that you have left (leaving the start area and moving), when you call off the appointment with a reason (e.g. sick, appointment cancelled), or automatically 60 minutes after the departure time; the appointment then counts as missed. There is no button that ends it without movement. If you are under 16 and in a family with Abmarsch Plus, the app asks the family's adult admins before you call it off; until one of them answers, the alarm comes back every 3 minutes. If there is no adult admin in the family or the family is paused (section 6), the reason is enough. From 16 you call it off yourself; whoever the appointment is shared with is told.

For the alarm to work, the app needs the permissions for location, motion, notifications and alarms. Without them Abmarsch cannot warn you reliably.

5. Account, family and age

6. Free and Abmarsch Plus

Abmarsch is available for free for one person and with the Abmarsch Plus subscription. There is no other paid plan.

7. Purchase, renewal and cancellation of Plus

8. Right of withdrawal for purchases

As a consumer in the EU or the EEA you have a statutory right of withdrawal of 14 days when you buy Plus. Because you conclude the purchase contract with the store (section 7), you declare the withdrawal to the store, and the store refunds the price:

You receive the withdrawal information and the model withdrawal form from the store. In Switzerland there is no statutory right of withdrawal for such purchases; refunds there follow Google Play's policies. We cannot refund payments ourselves because we do not receive them. Still, feel free to write to kontakt@abmarsch.app if something goes wrong – we will help you.

9. Updates and defects

10. Changes to the app

We keep developing Abmarsch. We only change features for a valid reason – for example new operating system versions, security, changes in the law or in data sources, or to improve the app – and at no extra cost to you. If a change impairs the use of Plus more than insignificantly, we will inform you clearly in advance; you can then end your subscription under the statutory rules (§ 327r of the German Civil Code). Servers may be briefly unavailable for maintenance; wake-up alarm, leave alarm and buffer then continue on the device with the data last loaded.

11. Fair use

It is prohibited to use Abmarsch to locate or monitor people without their knowledge, to add other people to a family against their will, to use nudges for harassment, to query the timetable server automatically or to manipulate the app technically. In case of a violation we may block your account, as a rule only after a warning; in serious cases (e.g. secretly locating a person) immediately. Your data on the device and your rights from a paid subscription remain unaffected.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, for fraudulently concealed defects, under a guarantee we have given and under the German Product Liability Act. In cases of slight negligence we are only liable for breach of essential contractual obligations (obligations whose fulfilment makes use of the app possible in the first place and on whose compliance you may regularly rely), and then limited to the foreseeable damage typical for the contract. Otherwise we are not liable for slight negligence. These rules also apply to the people we use to perform our obligations.

13. Term and end of use

14. Changes to these terms

If we change these terms, we will show you the new version in the app in good time beforehand. Changes that are solely to your advantage or purely linguistic apply from publication. For all other changes we ask for your consent; without it, the previous terms continue to apply to you. We may then end the free use under section 13; a paid subscription continues on the previous terms until the end of the paid period.

15. Governing law and dispute resolution

German law applies. If you live in another country as a consumer, you keep the protection of the mandatory consumer protection provisions of your country. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
